TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Éphémère platform, accessible at www.ephemere.org. By creating an account or using the service, you acknowledge having read and accept these Terms without reservation.

Purpose

Éphémère is an online platform enabling users to create, manage, and participate in events. These Terms define the conditions under which the service is made available and used.

Together with the Privacy Policy and the Cookie Policy, they form the contractual framework applicable between the publisher and the user.

Service Access

The service is freely accessible, twenty-four hours a day, seven days a week, except during maintenance operations and cases of force majeure.

Access requires an Internet connection and a modern web browser compatible with web standards. The publisher cannot be held responsible for connection costs or any malfunctions resulting from your equipment.

Some features require account creation, under the conditions described in the next section.

User Account

Account creation is performed by authentication via a one-time password (OTP) sent to your email address, or through a third-party identity provider (Google or Facebook).

You warrant the accuracy of the information provided and commit to maintaining the confidentiality of authentication elements associated with your account. All actions performed from your account are presumed to be performed by you.

Use of the service by a minor is subject to compliance with the rules of Article 8 of the GDPR and Article 45 of the Data Protection and Digital Freedoms Law. In France, a minor under fifteen years of age cannot create an account without the authorization of the holder of parental authority.

You may at any time request deletion of your account. The consequences of this deletion on your data are described in the Privacy Policy.

User Content

"User content" means all elements you publish or enter on the platform: organization descriptions, event pages, participant lists, associated notes, and more generally any data you communicate via the service.

You remain the sole holder of rights relating to your content. You grant the publisher, solely for the purpose of operating the service, a non-exclusive, free license limited to the duration of your use of the service, authorizing it to host, reproduce, and display your content to recipients you have designated.

You are solely responsible for the content you publish. You warrant that you have all necessary rights and authorizations, in particular for data concerning third parties (event participants, notably minors, for whom you must have obtained required authorizations from holders of parental authority).

Strictly prohibited are unlawful, defamatory, insulting, hateful content, violating the privacy of others, infringing, or otherwise harming the rights of third parties. The publisher reserves the right to remove any manifestly unlawful content brought to its attention, in accordance with Article 6 of Law No. 2004-575 (LCEN).

Rules of Use

By using the service, you commit to:

  • Not extracting in an automated manner all or any part of the contents or data accessible via the platform (scraping, aspiration, unauthorized indexing).
  • Not harming the integrity, availability, or security of the service (intrusion, denial of service, injection, exploitation of vulnerabilities).
  • Not attempting to circumvent the technical protection measures implemented.
  • Respecting other users and refraining from any conduct constituting harassment, identity usurpation, or attacks on dignity.
  • Not using the service for purposes other than its intended use, particularly unsolicited commercial prospecting.

Any material breach may result in account suspension or termination, without prejudice to civil or criminal proceedings the publisher may pursue.

Reporting a Breach

In accordance with Article 6-I-7 of Law No. 2004-575 of June 21, 2004, on trust in the digital economy (LCEN), we provide a reporting channel allowing us to be notified of any manifestly unlawful content or conduct breaching these Terms of Service.

This includes in particular:

  • Child sexual abuse material, apology for crimes against humanity, incitement to racial hatred or violence.
  • Harassment, identity usurpation, or violations of the privacy of a third party.
  • Situations endangering a minor, particularly during events or sports competitions.
  • Infringement of copyright or other intellectual property rights.

Reports should be sent to abuse@ephemere.org and should specify, to the extent possible, the URL or reference to the content in question, the nature of the alleged breach, and, if relevant, your status (victim, witness, legal representative). Any manifestly abusive notification engages the liability of its sender, in accordance with Article 6-I-4 of the LCEN.

We commit to examining each report as quickly as possible and, where the breach is established, to remove the disputed content or take any measure proportionate to the gravity of the facts.

Intellectual Property

The trademark "Éphémère," the domain name ephemere.org, source code, technical architecture, visual identity, and all elements comprising the platform are the exclusive property of the publisher or subject to a license granted to it.

Any reproduction, representation, modification, or exploitation, in whole or in part, without prior written authorization, is strictly prohibited and constitutes an infringement punishable under Articles L. 335-2 et seq. of the Intellectual Property Code.

User content remains the property of its respective authors, under the conditions defined in the "User Content" section.

Liability

The publisher is bound by an obligation of best efforts in providing the service. It implements reasonable diligence to ensure availability, security, and integrity of the platform, though without guaranteeing uninterrupted availability or absolute absence of error.

To the extent permitted by applicable law, the publisher's liability cannot be engaged for indirect damages, nor for data loss resulting from a cause beyond its control, nor for content published by users.

The publisher cannot be held liable for a breach resulting from force majeure, within the meaning of Article 1218 of the Civil Code, nor from an act of a third party or the user themselves.

The provisions of this section are not intended to exclude or limit a liability that the law prohibits excluding or limiting, particularly in case of gross negligence, willful misconduct, or bodily injury.

Suspension and Termination

The publisher may suspend or terminate access to the service in case of breach of these Terms, conduct harming the rights of a third party or service security, or upon demand of a competent authority.

Except where urgency justified by the nature of the breach applies, suspension is preceded by notification via email specifying the reason and inviting the user to remedy the situation within a reasonable timeframe.

You may, for your part, terminate your account at any time from your personal space or by writing to privacy@ephemere.org. The consequences of termination on your data are described in the Privacy Policy.

Changes to These Terms

The publisher reserves the right to modify these Terms to reflect changes to the service or applicable legal framework.

Any material modification will be notified to you by email or visible notification on the service at least fifteen days before it becomes effective. Continued use of the service beyond this date constitutes acceptance of the revised Terms.

Applicable Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, the parties will endeavor to find an amicable solution before any court action. Failing this, and subject to mandatory consumer protection rules, French courts shall have sole jurisdiction.

In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission makes available to consumers an online dispute resolution platform accessible at ec.europa.eu/consumers/odr.
